Terms & Conditions for Instrument Rentals

1. Quality and Fitness

1.1 Hickies Ltd warrants that the Goods will be of satisfactory
quality and fit for their intended purpose.

1.2 If you believe the Goods are not of satisfactory quality or fit
for purpose, you must inform Hickies Ltd immediately so that
the Goods may be examined and, where appropriate, repaired or
adjusted.

2. Repairs and Maintenance

2.1 All repairs, adjustments and maintenance must be carried
out only by Hickies Ltd or its appointed agent.

2.2 You are responsible for returning the Goods to Hickies Ltd (or
its appointed agent) for any repair, adjustment or maintenance.

3. Ownership and Use

3.1 The Goods remain the property of Hickies Ltd at all times
during the Agreement.

3.2 You must not treat the Goods as your own and must not sell,
hire, lend, dispose of, or otherwise deal with the Goods.

4. Risk, Loss and Damage

4.1 Risk in the Goods passes to you for the duration of the
Agreement.

4.2 You must notify Hickies Ltd immediately of any loss of or
damage to the Goods.

5. Indemnity

5.1 You agree to indemnify Hickies Ltd against any loss, damage,
liability, cost or expense arising from your failure to comply with
clauses 1 to 4.

6. Payments

6.1 The monthly rental charge is payable by direct debit.

6.2 If any monthly payment is not honoured, the Goods must be
returned to Hickies Ltd promptly and upon request.

7. Delivery, Access and Safety

7.1 Delivery is subject to an access and safety assessment. If
Hickies Ltd’s delivery team determines that delivery to the
agreed location cannot be completed safely or without undue
risk of damage, Hickies Ltd may:

(a) deliver the Goods to the nearest safe point;
(b) propose an alternative delivery arrangement; or
(c) cancel and refund any charges relating to the undeliverable
portion and any sums paid for services not provided.

7.2 You must provide accurate access details in advance and
ensure the delivery route is clear and unobstructed at the time of
delivery.

8. Changes to Details and Address

8.1 You must inform Hickies Ltd of any change to your personal
details.

8.2 Free collection will only be offered from the same address to
which the Goods were delivered.

8.3 In the case of acoustic pianos, any removal to a new address
must be carried out by Hickies Ltd.

9. Minimum Term and Termination

9.1 The Agreement is for a minimum period of 3 months, or 6 months
for all pianos, then the contract automatically continues on a rolling
monthly basis.

9.2 After the minimum rental period, the Agreement may be
terminated only once the Goods have been returned to Hickies Ltd.

10. Returns and Condition

10.1 It is your responsibility to return the Goods in order to terminate
the Agreement.

10.2 For pianos, you must contact Hickies Ltd to arrange collection.
The Goods remain your responsibility until collection takes place.

10.3 The Agreement continues, and rental charges remain payable,
until Hickies Ltd has received the Goods.

10.4 The Goods must be returned in the same condition as supplied,
allowing for fair wear and tear, including removal of any stickers or
adhesive items.

10.5 You are liable for the cost of repair or replacement if the Goods
are damaged during the Agreement.

11. Rental Credit Toward Purchase

11.1 Rental payments made within the first six (6) months may be
used towards the purchase of a new instrument of the same type.

11.2 Rental payments made after the first six (6) months cannot be
deducted from a purchase.

12. Law and Jurisdiction

12.1 This Agreement is governed by English law.

12.2 The courts of England and Wales have exclusive jurisdiction
over any dispute arising out of or in connection with this Agreement.

13. Enforcement and Legal Costs

13.1 Hickies Ltd may commence legal proceedings in respect of any
breach of this Agreement.

13.2 You are responsible for the costs associated with any such legal
proceedings.

14. Entire Agreement

14.1 This Agreement constitutes the entire agreement between you
and Hickies Ltd and supersedes all previous agreements,
understandings or representations relating to its subject matter.
