Terms & Conditions for Instrument Rentals

Hickies Ltd warrants that the Goods shall be of satisfactory quality and fit for purpose. In the event that you believe this not to be the case, you must inform Hickies Ltd immediately so that an examination of the Goods may be carried out, and if necessary, any repairs or adjustments made.

Any repairs or adjustments must be carried out by Hickies Ltd or its chosen agent. It is your responsibility to return the instruments to Hickies or its chosen agent for the repair or any maintenance.

During the duration of the Agreement, the Goods remain the property of Hickies Ltd. You are not permitted to treat the Goods as your own whatsoever. In particular you are not permitted to sell, hire, lend or in any way deal with or dispose of the Goods.

During the duration of the Agreement the risk in the Goods shall pass to you and you shall inform Hickies Ltd immediately should any loss or damage occur in respect of the Goods.

You agree to indemnify Hickes Ltd from any loss or damage should you fail to comply with paragraphs 1 to 4 above.

The monthly rental charge is payable by way of direct debit.

In the event that a monthly payment is not honoured, the Goods must be returned to Hickies Ltd.

You must inform Hickies of any change to personal details. When a delivery is made by us, free collection will only be offered from the same address.

The Agreement is for a minimum period of 3 months or 6 months in the case of all pianos rented (the “Initial Period”). After this period the Agreement may be terminated but only once the Goods have been returned to Hickies Ltd.

All rental payments within the first 6 months of an instrument rental can be used towards (and subtracted from) the cost of any new instrument of the same type. (But no rental payments after this 6 month period can be deducted from a purchase).

It is your responsibility to return the Goods to Hickies in order to terminate the rental Agreement. In the case of pianos you must contact Hickies to arrange a collection, the Goods remain your responsibility until the point of collection. Until the Goods are returned to Hickies the Agreement continues and monthly payment will still be required. Goods must be returned in the same condition as they were taken in, this includes removing any stickers that have been added to the instrument. If the goods are damaged during the hire period you will be liable for the cost of repair or replacement.

The Agreement is subject to English Law and the courts of England and Wales shall have exclusive jurisdiction to settle any dispute arising out of or in connection with the Agreement.

Hickies Ltd reserves the right to commence legal proceedings against you in respect of any breach of the Agreement. The costs associated with any such legal proceedings will be met by you.

The Agreement constitutes the entire agreement between you and Hickies Ltd and supersedes and extinguishes all previous agreements, promises, assurances, warranties, representations and understandings between them, whether written or oral, relating to its subject matter.
